Keep Compliance on the Radar

As you have heard, beginning January 1, 2018 the Department of Licensing and Regulatory Affairs (LARA) will undertake greater enforcement of real estate advertising, including the clarification on type size. Over the next several months, Michigan Realtors® will be embarking on a communications campaign to make sure that all Realtors® are informed and in compliance. LARA is indicating that it will be more active in the enforcement of real estate advertising. To that end, it is important that all Realtors® review their advertising to ensure that it satisfies the current requirements as well as those that are forthcoming on January 1, 2018.

QUESTION:
I am a designated agent and have a listing that is generating a lot of interest. I currently have multiple offers including one that is from another designated agent in my firm. I was told that I must disclose to the other buyers that one of the offers is an in-house offer. Is this correct?

ANSWER:
You must disclose the relationship of your firm to the in-house buyer and to the seller; however, you have no legal obligation to disclose the in-house status of one buyer to the other buyers.

MSHDA: Michigan Down Payment

The Michigan State Housing Development Authority (MSDHA) makes it easy to market your eligible listings to new prospective buyers. With a new downloadable marketing kit, including a “MSHDA eligible” icon, your listings can stand out from the rest to prospective buyers.

For many first-time homebuyers, monthly mortgage payments are comfortably within the budget, but savings for a large down payment, closing costs, improvements and other expenses are intimidating at best and impossible for many. In fact, 55 percent of future first-time homebuyers have not considered purchasing a home because they lack funds for a down payment, according to a 2016 MSHDA survey.

MSHDA removes one of the biggest hurdles to owning a home with a Michigan Down Payment up to $7,500 on a new home and homeowner education, creating new prospective homeowners across the state. Our online eligibility tool makes it effortless for buyers to see if they qualify. First-time homebuyers and some previous homeowners are eligible with two different loan programs: MI Home Loan and MI Home Loan Flex – both are fixed rate mortgages with 30-year terms.
