The state of Indiana will not handle that deadline like retail in December, meaning you will not get an email the day after saying Extended! or Extra day to renew! or Last last chance! Instead, on July 1st, your license will be invalidated and you will be required to complete a 90-hour pre-licensing course before participating in another transaction. Be Aware:  Pocket Listings Raise Legal and Ethical Flags
A pocket listing is one not entered into the listing service. Done for a number of reasons and handled in a few different ways, pocket listings raise legal and ethical flags about which all members need to be aware. Watch this five-minute video jointly produced by IAR and RECP for more on the types of pocket listings, the reasons they’re used and how to keep them legal and ethical.

Residential Forms Changes Announced for 2014
Slight revisions to the residential Purchase Agreement and Listing Contract are being made for 2014. And some new forms will be available January 1st including an Agreement Regarding Personal Property, an Amendment to Lease Agreement and a Supplemental Indemnification Agreement. Find out more here

Commercial Forms Changes Announced for 2014
Five new commercial forms will be available in January. Those forms are titled as follows:  1) Exclusive Tenant Representation; 2) Exclusive Tenant Representation (With Tenant Payment); 3) Purchase Agreement Commercial (Land Only); 4) Registration and Commission Agreement; and 5) Amendment to Listing Contract-Commercial. Legal Hotline Authorizations to be Purged December 31st
On December 2nd, IAR gave notice via email to its Principal and Managing Broker members that all previous authorizations for designated agents to use the Legal Hotline would be purged as of 5:00 pm EST this coming December 31st. Starting now and going forward, Broker members may still designate agents to use the Legal Hotline, but will need to do so via this online authorization form. If Brokers wish to make changes after this initial authorization, they may do so using the authorized user update form found online at > Legal Affairs > Hotline. Both forms were created in an effort to make the authorization process easier for Brokers and to ensure authorizations stay current. Call the Legal Hotline with questions:  1-800-444-5472.

Venue Change Announced for Legislative Conference
Join IAR members from across the state at the Legislative Conference slated for January 27 & 28 in downtown Indianapolis. While the schedule mirrors last year’s newly condensed and focused format, the longtime event venue has changed to the JW Marriott Indianapolis. Conference registration should open the week between Christmas and New Year’s Day, however you can book overnight accommodations now via this link that will give you the special IAR rate of $144 per night plus tax. Or, you can call 1-877-303-0104 and request the special IAR rate. The deadline is January 7th.

Salespersons Urged to Upgrade Licenses ASAP
The deadline for real estate salespersons to upgrade their license to broker status is June 30, 2014. While that’s six months away, IAR urges its salesperson licensed members to take action now to avoid the traffic jam we foresee.

According to the state of Indiana, more than 7,500 salespersons still need to upgrade their license. Processing that many license renewal requests from here forward will be a challenge by itself, but on top of that, the state also be processing license renewal requests from legacy brokers (one of the major changes of last year’s real estate license law update was to put all licensees on the same renewal cycle). And, the state will be processing license renewal requests from other professions.

There are two steps to the upgrade:  one, complete a 24-hour broker transition course through a state-approved education provider, and two, renew your license with the state. If you do not complete both steps prior to June 30th of next summer, your license will be invalidated and you will be required to complete a 90-hour pre-licensing course before participating in another transaction.

But, do not worry; RECP has made it easy for salespersons to upgrade. Learn more below.

Did you ever wonder just how a bill becomes a law? Members of the Indiana REALTORS® Leadership Academy Class of 2013-2014 can now answer that for you.  Class members met with the IAR Government Affairs staff as well as top state officials at the Indiana State House to learn about government and the political process.  Check out more information on the class and what they learned here.

RECP Makes it Easy for Salespersons to Upgrade License
RECP has made it easy for salespersons to upgrade their license to broker status before next summer’s deadline of June 30th. Through RECP, salespersons can take the mandatory broker transition course one of the following ways:  1) In-person over a period of three days at a variety of locations around the state; 2) Online; or 3) Online and on-demand (at 4:00 a.m. in your pajamas, anyone???).

As a reminder, the broker transition course fulfills a salesperson’s continuing education requirement during this transition period we’re currently in. And as an added bonus, REALTOR® licensees who complete the course through RECP will earn 22 credits toward a Graduate, REALTOR® Institute (GRI) designation.
