Make Your Voice Heard at the Statehouse
Join members from across the state at the IAR Legislative Conference slated for January 27 & 28 in downtown Indianapolis. At the heart of this annual event is the REALTOR® Day at the Statehouse, which is an important opportunity to help shape laws and policies that affect your profession and the marketplace. It is true that there is strength in numbers and unity, so please plan to be part of IAR’s legislative success by registering to attend.

While the conference schedule mirrors last year’s newly condensed and focused format, the longtime event venue has changed to the JW Marriott Indianapolis. Kendall Named by Inman News to Top 100 List
Congratulations to Carrie Kendall on being named to Inman News’ annual list of 100 Most Influential Real Estate Leaders. Carrie earned her spot in the industry trade groups/MLSs category of the list as General Manager of the Indiana Regional MLS, which was formed in August 2012 to consolidate the listing data and services of 13 REALTOR® associations in Indiana. Once the consolidation is complete, 5,000 members will have access to more than 750,000 listings across 42 counties in a single database. Carrie is also CEO of the Lafayette Regional Association of REALTORS®.

Salespersons Urged to Upgrade Licenses ASAP
The deadline for real estate salespersons to upgrade their license to broker status is June 30, 2014. While that’s nearly six months away, IAR urges its salesperson licensed members to take action now to avoid the traffic jam we foresee. There are two steps to the upgrade:  one, complete a 24-hour broker transition course through a state-approved education provider, and two, renew your license with the state. If you do not complete both steps prior to June 30th of this summer, your license will be invalidated and you will be required to complete a 90-hour pre-licensing course before participating in another transaction. But, do not worry; RECP has made it easy for salespersons to upgrade. Learn more below.

November Home Sales Slow Slightly in Seasonal Adjustment
After 28 months of year-over-year increases in the number of existing, single-family homes sold statewide, that number slightly decreased in November by 1.6 percent when compared with November 2012. However, the average and median sale price of those 5,475 homes sold in Indiana during November increased in the year-over-year comparison, and both the year-to-date comparisons of closed home sales and prices indicate 2013 will still finish well ahead of 2012. Be Aware:  Pocket Listings Raise Legal and Ethical Flag
A pocket listing is one not entered into the listing service. Done for a number of reasons and handled in a few different ways, pocket listings raise legal and ethical flags about which all members need to be aware. Watch this five-minute video jointly produced by IAR and RECP for more on the types of pocket listings, the reasons they’re used and how to keep them legal and ethical.

Residential Forms Changes Announced for 2014
Slight revisions to the residential Purchase Agreement and Listing Contract were made for 2014. And some new forms became available to members January 1st including an Agreement Regarding Personal Property, an Amendment to Lease Agreement and a Supplemental Indemnification Agreement. Commercial Forms Changes Announced for 2014
Five new commercial forms are now available to members. Those forms are titled as follows:  1) Exclusive Tenant Representation; 2) Exclusive Tenant Representation (With Tenant Payment); 3) Purchase Agreement Commercial (Land Only); 4) Registration and Commission Agreement; and 5) Amendment to Listing Contract-Commercial. Also, revisions were made to the existing Purchase Agreement and Listing Contracts for 2014. Find out more here.

Reminder:  please use ZipFormPlus.com to access your IAR forms regardless of whether you are still using zipForm® 6 or you have already upgraded to zipForm® Plus. Legal Hotline Authorizations to be Purged December 31st
On December 2nd, IAR gave notice via email to its Principal and Managing Broker members that all previous authorizations for designated agents to use the Legal Hotline would be purged as of 5:00 pm EST this past December 31st. Starting January 1st and going forward, Broker members may still designate agents to use the Legal Hotline, but will need to do so via this online authorization form. If Brokers wish to make changes after this initial authorization, they may do so using the authorized user update form found online at IndianaRealtors.com > Legal Affairs > Hotline. Both forms were created in an effort to make the authorization process easier for Brokers and to ensure authorizations stay current. Call the Legal Hotline with questions:  1-800-444-5472.

RECP Makes it Easy for Salespersons to Upgrade License
RECP has made it easy for salespersons to upgrade their license to broker status before this summer’s deadline of June 30th. Through RECP, salespersons can take the mandatory broker transition course one of the following ways:  1) In-person over a period of three days at a variety of locations around the state; 2) Online; or 3) Online and on-demand (at 4:00 a.m. in your pajamas, anyone???).

As a reminder, the broker transition course fulfills a salesperson’s continuing education requirement during this transition period we’re currently in. And as an added bonus, REALTOR® licensees who complete the course through RECP will earn 22 credits toward a Graduate, REALTOR® Institute (GRI) designation. Register online or call 1-800-742-4067 for more information.
