Expanding Sales Tax to Services Discussed at State Tax Conference

Expanding the state sales tax to services was discussed at the recent Indiana Tax Competitiveness and Simplification Conference hosted by Governor Mike Pence. The invitation only event brought together nearly 200 local and national tax experts and policy makers, including IAR staff, for a day long “exploration of ways to create a more competitive business and individual tax climate in Indiana”. The formal speakers and panelists generally advocated tax simplification and fairness, which is likely to be the foundation of a plan the Governor hopes to present to members of the General Assembly before they begin their work in January. Broadening the tax base by taxing services, which could potentially include real estate transactions, was also a common theme. IAR has since initiated conversation with members of the Pence administration and other like-minded stakeholders to ensure the REALTOR® voice is heard loud and clear:  we strongly oppose sales tax on services and will fight for a seat at the table when it comes to discussing broad-based tax reform. Seller’s Disclosure Form Updated

You may have last week received an email from the Indiana Professional Licensing Agency/Indiana Real Estate Commission letting you know an updated Seller’s Residential Real Estate Sales Disclosure form was available on the IPLA/IREC website. The updated form has since been added to your statewide transactional forms (zipForm®) and the Legal Library at IndianaRealtors.com. What changed? Violation Station:  Real Life Real Estate Sanctions

What happens if Indiana real estate license law is violated? “Violation Station” is published quarterly to help REALTORS® better understand the types of violations heard by the state of Indiana’s Real Estate Commission and the punishments IREC hands out. IAR’s Senior Staff Counsel, Kelly Shonborn, reviews first quarter sanctions here.

IAR Director Candidate Applications Due August 15

The annual electronic election of IAR Directors is scheduled for September 22-26. According to membership counts taken from the National REALTOR® Database System earlier today, the following IAR Director positions are available for qualified candidates to pursue (no change from July 3 newsletter) Apply online by August 15 to stand for election.

  • Past IAR Presidents – 1 representative

  • Indiana Commercial Board of REALTORS® - 1 representative

  • Top 20 Firms - 1 Managing Broker representative

  • Local Association Presidents - 1 small, 1 large association representative

  • Region 1 – 3 representatives

  • Region 2 – 1 representative

  • Region 3 – 1 representative

  • Region 4 – 5 representatives

  • Region 5 – 1 representatives

  • Region 6 – 1 representative

All active members may participate in the IAR Director election. Ensure receipt of a ballot by asking your local REALTOR® association staff to enter a valid email address in NRDS before September 5.

Get a Jump on Annual CE Requirement

As of July 1, all active Indiana real estate licensees are on the same three year license renewal cycle with a 36 hour continuing education requirement. Twelve CE hours must be completed per year. Curriculum will vary by license type* and was just finalized by the Indiana Real Estate Commission. Sign up here to be among the first notified when the new CE packages are available from RECP.

*In the July 18 newsletter we answered this FAQ:  what does Managing Broker Eligible mean? A part of the answer was that if your personal record on the state of Indiana’s public licensing search (the less info you enter to search, the better) says you are “Managing Broker Eligible”, four of your annual 12 CE hours must be dedicated to the necessary business and management skills and legal knowledge needed by a single Managing Broker. Mark your calendar for the morning of September 30. RECP is bringing Chicago’s Marki Lemons to Indianapolis to fulfill this four hour CE requirement. The class will take place during IAR’s annual conference and centennial celebration. Look for registration to open mid-August.

Serve on Indiana’s GRI Advisory Council 

If you have earned a GRI designation and hold active REALTOR® or REALTOR® Associate membership in Indiana, we may have an opportunity for you. The state’s Graduate, REALTOR® Institute Advisory Council is looking for new members to represent IAR Regions 5 and 6, and REALTORS® under 40 years of age. GRI Advisory Council members make curriculum recommendations and guide programming, thus helping maintain the integrity and prestige of the GRI designation. Advisory Council members promote GRI and in doing so, add to their personal and professional networks, as well as advocate for advanced education among real estate professionals. Last, but not least, Council members are a valued part of IAR’s leadership. Term length is three years. Online applications are due August 8.

Enrollment Now Open for Pre-licensing Courses

As of July 1, the first step for anyone wanting to start a real estate career in Indiana is to successfully complete a 90 hour pre-licensing Broker course. However, the state will only grant a license to those who are 18 years old and have earned a high school diploma or passed an equivalency exam. RECP has started to schedule live pre-licensing courses at locations around the state. An online/on-demand pre-licensing course will be available early August. Enroll now.

Mark Porter to Lead Designation Days Event 

The dynamic Mark Porter will bring his 23 years of experience as a real estate broker, investor, and consultant to Indiana for three full days this fall when he leads the biannual IAR-RECP REALTOR® Professional Designation Days event scheduled for October 21-23 at Indiana Wesleyan University’s Indianapolis-North campus. Learn about planning, systems, and technology as you earn credit toward the prestigious Graduate, REALTOR® Institute (GRI) and Certified Residential Specialist® (CRS®) designations. Mark’s courses foster time saving and income producing habits, are taught in a fun and engaging environment, and qualify for elective continuing education hours. NAR Testifies on Flood Insurance

On July 23, 2014, NAR testified on flood insurance before a Senate appropriations subcommittee.  The hearing was called to evaluate FEMA’s first four months in implementing recent reforms to the National Flood Insurance Program (NFIP).  REALTOR® Donna O. Smith (S.C.), who is overseeing NAR’s efforts on the NFIP, ably delivered the testimony for NAR.  REALTOR® Smith testified that overall, FEMA’s early decisions to conduct outreach and provide for broader rate relief and refunds have helped to calm real estate markets.  While there has been progress, NAR will continue to closely monitor FEMA’s efforts this fall when refunding all those property owners who were overcharged for flood insurance since 2012.  NAR also urged FEMA to expedite particular reforms which set up a government office of the Advocate who can and will go-to-bat with the insurance companies or FEMA on behalf of homeowners who challenge faulty rate quotes and flood maps.
