Continuing Education Changes Make Way to the Governor’s Desk for Signature

Legislation expanding options for Continuing Education continues on its path toward law. As you may already know, Senate Bill 641 sponsored by Senator Mike Kowall (R-White Lake Twp) enables the association to be more responsive to the needs of licensees, changes in the market, and changes in technology. In addition, this bill allows for greater flexibility in what can be offered and approved for real estate continuing education.

The bill has passed both the House and Senate unanimously, and is expected to be signed by the Governor in the coming weeks.

MSHDA Offers “MI NEXT HOME” for Repeat Homebuyers

March 2014 - REALTORS® in Flint and Grand Rapids support the launch of MSHDA's "MI Next Home" loan program.

The Michigan State Housing Development Authority (MSHDA) has announced an exciting new loan program for repeat homebuyers. MSHDA’s MI Next Home has been created to make down payment assistance available to repeat buyers. The program was designed specifically for those applicants who may not qualify for MSHDA’s existing MI First Home program due to their previous homeownership status. 

The Down Payment Assistance is a 0% interest rate loan that has no payments and does not become due until the homebuyer sells the home, pays off the first mortgage or refinances the existing mortgage.

Broker Summit Early Registration Closes Friday, April 11

There is still time to register for the 12th annual Broker Summit, taking place April 23rd at Ford Field, Detroit. Knowledge sessions are approved for continuing education credit, including a Real Estate and Economic Outlook with NAR Chief Economist, Lawrence Yun. REALTOR® Emeritus Candidate Forms Due 

April 2nd is the deadline to complete certification forms for REALTOR® Emeritus status, which recognizes REALTOR® and REALTOR®-Associate members with 40 years of continuous membership. Applications must be submitted no later than April 2, 2014 to be considered for approval by the Board of Directors at the REALTOR® Party Convention & Trade Expo in May.

With the help of McClelland & Anderson, we are taking the most recently asked questions from our legal hotline and putting them in E-news. We will be featuring a different question each issue.

QUESTION:
It recently came to my attention that I am required to provide a written policy and procedures manual. Is this true?

ANSWER:
YES. Rule 310 (R 339.22310), provides that a broker must supervise the work of a licensee. “Supervision” is defined to include “at a minimum” all of the following:

  1. Direct communication in person or by radio, telephone, or electronic communication on a regular basis.
  2. Review of the practice of the supervised licensee.
  3. Review of the supervised licensee’s reports.
  4. Analyses and guidance of the licensee’s performance in regulated activities.
  5. PROVISION OF WRITTEN OPERATING POLICIES AND PROCEDURES.
