Scam Alert! Hacked Email Accounts Result in Fraudulent Transfer Solicitations

A fairly new email hacking scam has been identified around the nation. The perpetrators of the scam are hacking emails and posing as the owner of the respective email account. They are then intercepting communications between Realtors® and their clients and attempting to use that information to trick the client into a money wiring scam.

It has been reported that clients have received email communications requesting that large "refundable deposits" be wired for the purposes of speeding up a closing or reducing an interest rate. While this may seem like a fairly complicated and far-fetched scam, we are aware of at least one instance where the scam was successful. Please be aware of this activity and consider informing clients that there are certain communications that will never be made through email, at least not without additional in-person contact. Further, change your passwords regularly to protect the security of your email accounts.

Legal Lines – Question of the Month

With the help of McClelland & Anderson, we are taking the most recently asked questions from our legal hotline and putting them in E-news. We will be featuring a different question each issue.

I represented a buyer of a Fannie Mae/Freddie Mac property who paid the Michigan real estate transfer tax. Now that a recent Federal Circuit Court ruling has said that Fannie Mae/Freddie Mac are exempt from transfer tax, is my buyer eligible for a refund?
YES. Assuming that the transaction occurred within the last four years, the buyer can obtain a refund by filing form 2796 with the Michigan Department of Treasury, along with a copy of the settlement statement (HUD-1) and the recorded deed containing the tax stamp.
