If you read the Portland Mercury, you’ve probably seen the August 12, 2015 article, “A Preemptive Strike, State Laws Are Stymieing Local Efforts to Fund Affordable Housing” by Shelby King. Certainly housing affordability issues are something the Oregon Association of REALTORS® care deeply about. Our manifesto, in part, reads “We believe in perpetuating the dream of home ownership and opening the door to those who have yet to achieve it.” Unfortunately, forming a comprehensive policy that propels our goal of increasing home ownership is a monumental task, and one that isn’t without controversy. READ MORE »

Stop Patent Trolls - DEADLINE: LABOR DAY!

If only these kind of trolls were this cute! Instead, there really are predatory people out there who are not trying to protect but rather monetize patents and come after hard working professionals like REALTORS® who are just trying to conduct normal business involving technology. When these trolls hold “patents” on the tech and sue someone over it, it’s often cheaper to just settle than fight it in court. And that’s how they make their money and it’s not just pocket change either. These settlements can run in the high five to low six figures! And E&O insurance doesn’t cover it.

So, what can you do about it? With just a couple clicks, you can send a letter to your member of Congress in support of legislation that would help curb abuses by patent trolls. Many in real estate have been hit with patent demand letters for using everyday technology, and House lawmakers have crafted H.R. 9 to help curb the practice. Let’s stand together to stop this predatory business practice!

Navigating the Changes to the Closing Process

There are three things you need to know now about changes to the closing process.

1) The Consumer Financial Protection Bureau (CFPB) officially announced the Oct. 3 deadline for implementing the TILA/RESPA Integrated Disclosure Rule, or TRID. The new date gives lenders, title agents, and real estate professionals an additional two months to prepare for the changes, which were originally scheduled to take effect Aug. 1.

 

2) In case you missed it live, you can learn about the changes to the closing forms and procedures in a recorded hour-long webcast with closing expert Phil Schulman and NAR Senior Counsel Finley Maxson.

 

3) The CFPB just released a toolkit on TRID that they’re calling “Know Before You Owe: The Real Estate Professional’s Guide.” It’s available here, and is designed to help real estate professionals understand the changes to the closing process and how to explain the changes to your clients.

HUD Tweaks REO Disposition Handbook

Heads up to anyone registered with the U.S. Department of Housing and Urban Development to list or sell HUD Real Estate Owned (REO) properties. FHA is updating its handbook on property disposition. It appears that the new sections reflect existing guidance with minor tweaks to modernize the language to reflect industry tools (such as on-line marketing options through MLS, blogs, social media or the use of pay.gov rather than paper checks). READ MORE »

We received notification of a timeshare scam in Ohio that you may need to be aware of. We haven’t heard of anything similar in Oregon yet, but it never hurts to be vigilant. An individual or group which claims to be an Ohio licensed real estate company is soliciting consumers across the country, specifically timeshare owners, and promising to purchase their timeshare property. READ MORE »
